消防系统的设计、设备采购和施工应该具有代表性。通过这个案例可以看海外EPC合同的“苛刻”条款；海外合同与国内合同执行的问题之一“标准”

根据对外EPC合同内容：

范围描述：

Fire detection and alarm system, Fire prevention system and Fire fighting system shall be designed to provide a safer operating environment for personal and equipment and fulfill the following basic tasks

- Early Fire Detection, Alarm and Extinguishing

- Resistance of Fire blazing or spreading

- Personal Protection

- Reduction of Fire consequences

设计施工标准的规定

…Safe spacing among buildings, maximum floor area between fire barrier walls, number of escapes and maximum distance to the escapes etc. shall be as per the guidelines of   XXXX standard TCVN 2622-1995.The works to be carried out under this section of the Contract and the scope of supply shall be generally as indicated in the Bid Drawing No. CN-15.0001 to CN-15.0008.and designed in accordance with the Local Regulations and International Standards.

设计批准和工程验收规定

The Contractor shall forward the necessary sets of detailed drawings and other necessary documents on the fire-fighting and detection and alarm system to the Owner for onward submission to the Fire Authorities of XXX. The Contractor shall pay all fees as required by the Fire Authorities in order that the necessary approval can be obtained.

The Contractor shall submit the complete design to Fire fighting and protection department (Ministry of Police) for approval. After completion of erection, commissioning, the Contractor shall notify the fire fighting and protection department for their checking, taking-over and issuing acceptance certificate. All the above activities and expenses related the above shall be in Contractor’s scope.

通过对合同的研究，首先范围清楚了，火灾报警系统、气体灭火系统（包括洁净气体和二氧化碳）、水喷淋系统、常规水消防、泡膜灭火系统、消防水泵设备和移动灭火器设备。以上系统的设计、设备和施工。

按合同要求设计和设备采购规范的标准需要根据当地法律法规和国际标准，而我们中国的设计院在目前市场条件和做国外工程的水平上似乎离合同要求差距比较远。实际情况是，设计院按照国内标准执行设计和设备采购规范书的编写。虽然工作是往前走了，但是今后图纸和设备包括工程的验收必然涉及到对设计和设备采购使用的标准问题。在国外执行项目，虽然承包商有道理，有时候屈服业主的地位和境外项目执行的“压力”，但也会向业主妥协，尽量保证工程整体利益。更不用说承包商违背合同要求带来的风险。由于设计通过不过，图纸得不到批准，施工进度延误，最后的工期责任和罚款责任都是承包商。同时也影响合同款项的收取，带给承包商更大的资金压力。

解决方法：

1、要求设计院实施设计时候采用越南标准和相应国际标准

2、聘请有越南此类设计和施工经验的公司作为我们项目的咨询，从目前开始介入项目，根据当地标准和规定对设计院图纸进行审核，着手准备设备和工程的现场验收工作（包括业主和当地的消防部门）
